These Terms of Service ("Terms") govern the use of the website www.zafacare.com (the "Site") and the contracting of services with ZafaCare LLC ("ZafaCare", "we", "us"), a company organized under the laws of Puerto Rico (Merchant Registry #53629), with offices at Harbour View Building, 601 Ave. Fernández Juncos, San Juan, PR 00907. By using the Site or requesting our services, you agree to these Terms.

1. Description of Services

ZafaCare offers services including manual interior sanitization of trash cans/dumpsters and underground bins, repair and replacement of lids, hinges, and components, painting and restoration, installation of new trash cans, and recurring membership plans across all 78 municipalities of Puerto Rico.

2. Quotes and Scheduling

Quotes requested through the Site are estimates based on the information you provide and may be adjusted after an on-site evaluation. We coordinate the date and time of service with you; ZafaCare reserves the right to reschedule due to weather, access, or operational conditions.

3. Payments

Payments are processed via ATH Móvil, credit or debit card (Stripe), or cash, exclusively through our authorized personnel. ZafaCare never requests advance payments outside of these authorized channels. Current prices are communicated at the time of quoting and are subject to change without prior notice for future services.

4. Memberships

Monthly or quarterly membership plans are governed by the corresponding membership contract, which will be provided to you prior to enrollment. Cancellations must be requested at least 15 days prior to the next billing cycle; [Note: pending confirmation by Nicole regarding the final membership contract].

5. Text Messaging and Communications

By providing your phone number, you agree to receive phone calls, text messages (SMS), and WhatsApp messages from ZafaCare related to your service. Please refer to our Privacy Policy for more details about our text messaging program, including how to opt out (reply CANCEL or STOP).

6. Limitation of Liability

ZafaCare exercises reasonable care in providing its services. To the maximum extent permitted by law, ZafaCare shall not be liable for indirect, incidental, or consequential damages arising from the use of the Site or services, except in cases of proven gross negligence or willful misconduct. Nothing in these Terms limits liability for personal injury caused by ZafaCare's negligence, as permitted by applicable law.

7. Satisfaction Guarantee

If you are not satisfied with a service provided, contact us within 7 days so we can evaluate and, if applicable, correct the work at no additional cost. [Note: adjust if ZafaCare's actual policy standard differs].

8. Intellectual Property

All content on the Site, including text, images, logos, and design, is the property of ZafaCare LLC or its licensors and is protected by applicable intellectual property laws.

9. Governing Law

These Terms are governed by the laws of the Commonwealth of Puerto Rico. Any dispute shall be resolved before the competent courts of Puerto Rico.

10. Changes to These Terms

ZafaCare may update these Terms periodically. Your continued use of the Site or our services after an update constitutes your acceptance of the revised Terms.
